Seeds. Clones. A new lane for New York.
New York’s first adult-use nursery application window is closed. OCM will consider the first 50 submissions.
New York’s cannabis supply chain has a dedicated license for the plants that start it.
The first adult-use nursery application window opened November 5, 2026, at 10 a.m. EST. The board’s resolution limits review to the first 50 submissions in the order received. OCM will return the application fees for submissions received after the first 50.
Update, November 6: OCM lists the first application window as closed. Check OCM’s licensing page for future application rounds.
What the license covers
Nurseries can produce, package, label and distribute seeds, clones, immature plants and cultivation-related agricultural products. Their customers must be eligible state-licensed businesses, including cultivators, microbusinesses, cooperatives, registered organizations and other nurseries.
Who can buy directly?
The nursery license itself does not permit consumer or home-grow sales. A microbusiness or ROD with retail authorization can sell under that authorization. OCM separately describes medical sales through ROND medical-only dispensing facilities.
What review looks like
Applicants can receive a 30-day period to correct deficiencies. OCM expects applications to reach the Cannabis Control Board within several months, depending on each file. Submission is not approval: the board must grant the license.
Before the next round
Review OCM’s ownership restrictions, site control requirements, Agriculture and Markets nursery registration, and fees. OCM’s published checklist still lists a Labor Peace Agreement, while Chapter 369 repealed the statutory Labor Peace Agreement requirement. Confirm current application instructions with OCM before relying on the checklist.
